REPORT OF THE CONSTITUTION & BY-LAWS COMMITTEE

STATE CONSTITUTION & BY-LAWS CHANGES


1. Art. IX, Sec. 1, Paragraph 1, page 5

  • PRESENT LANGUAGE:
    The officers of this association shall consist of a President, Vice-President and a Secretary-Treasurer, whose election shall be annual; and five (5) Trustees. These officers shall constitute the Executive Board and the State Organizing Board. It is provided that the term of the office of Trustee shall be two (2) years each, with Trustees to be elected each year to take the place of those whose terms will expire. No State Officer shall continue to hold office in the TRLCA who currently holds or accepts a position in management, or another craft.
  • PROPOSED LANGUAGE:
    (Insert in place of last sentence of present language)
    No State Officer shall continue to hold office in the TRLCA who concurrently holds or accepts a position in management, a position in another craft, or any person appointed as State, <or> Assistant State, or Area Steward. The qualifications for a candidate as an Officer or Trustee of the Association shall be he/she is a member in good standing. (Any Officer currently serving as State, <or> Assistant State or Area Stewards shall be allowed to serve out their current term.) Passed as amended


2. ARTICLE: IX SECTION: 1 PARAGRAPH: 1, page 5

The President, Vice-President, Secretary-Treasurer, and State Steward shall be elected for one year or until their successors are elected and installed. Withdrawn

6. Art. X, Sec. 5, page 11

  • PRESENT LANGUAGE
    The State Steward, if retired from the USPS, shall be paid a salary $30,000 annually plus COLA Increases and shall receive $3,600 for office expense. If the State Steward is an active carrier, he/she shall be paid $16,000 annually and receive $3,600 for office expense.
  • PROPOSED LANGUAGE
    Section 5. The State Steward, if retired from the USPS, shall be paid a salary $30,000 annually plus COLA Increases and shall receive $3,600 for office expense. If the State Steward is an active carrier, he/she shall be paid an amount equal to the current annual salary for an evaluated route of 46 hours at step 12, and shall receive $3600 for office expense plus an additional annual salary of $12,000. This additional salary is compensation for any and all hours necessary over 46 hours per week.
    <Add new> Section 6. Retirement, Health and Life Insurance
    The Association shall pay only the necessary USPS portion of contributions for the State Steward of the Association to continue in the Federal Retirement, Health and Life Insurance programs in which he/she was enrolled preceding appointment to the position of State Steward.

7. Article XVII, Section 1, Paragraph 1, page 14

    The State Board, in conjunction with the NRLCA shall establish a retirement plan for their employees <elected and appointed officials>. Passed as amended

    Local Stewards
    All Local Stewards shall receive their daily rate of pay and <actual> mileage <to and from> for attending required training. Failed 302-196 after amendment

9. Article VI, Section 1, page 2

  • PRESENT LANGUAGE
    National Delegates
    Section 1. The State Association shall send delegates and (7) alternates to the National Convention subject to the restrictions of the National Association. The State Association shall set aside $9.00 per member for the state paid delegates' and alternates expenses to be divided equally among state delegates and alternates attending the National Convention.
  • PROPOSED LANGUAGE
    National Delegates
    Section 1. The State Association shall send delegates and (7) alternates to the National Convention subject to the restrictions of the National Association. The State Association shall set aside $14.00 per member for the state paid delegates' and alternates expenses to be divided equally among state delegates and alternates attending the National Convention. Passed

10. Article IV, Section 1, page 1

  • PRESENT LANGUAGE

    Every person who is a regular carrier or PTF, is granted membership in the State Association by paying to the State Secretary-Treasurer $169.00 dues plus National per capita. This will become effective July 1, 2000.
  • PROPOSED LANGUAGE
    Every person who is a regular carrier or PTF, is granted membership in the State Association by paying to the State Secretary-Treasurer $183.00 dues plus National per capita. This will become effective July 1, 2001 2002. Passed as amended


11. Article III, page 7

  • PRESENT LANGUAGE

  • PROPOSED LANGUAGE
    Add New Section 10
    He/she shall cause to be printed and made available to the membership a copy of the amended Constitution and By-Laws of the State Association within 90 days of each State Convention if there have been amendments passed at said convention. Failed


12. Article III, page 7

    Add new Section 2 and renumber subsequent sections.
    Section 2. Within 90 days after the close of each State Convention he/she shall prepare for publication in the Texas Carrier a correct copy of the entire proceedings of the State Convention. Failed


13. Article IV, Section 3, page 8

  • PRESENT LANGUAGE
    The voting record of each individual board member on any issue for which a roll call vote is taken shall be recorded in the minutes and both the minutes and the individual voting records shall be published in the State paper within 60 days after the minutes are approved.

    On any issue that the vote of the Board is not unanimous, the individual votes of the Board members shall be recorded ….. Failed

    Any duly elected delegate who accepts an assignment which is outside of direct Association business, such as an Auxiliary or Jr. Auxiliary assignment(s), and therefore, is unable to attend all required Association sessions, shall forfeit their delegate status and compensation. This forfeiture shall occur as soon as the assignment is accepted in order to allow for seating of eligible delegates. Failed

16. Article VI, Section 4 Page 3

  • PRESENT LANGUAGE
    It shall be the duty of the State Secretary-Treasurer to prepare a ballot listing the nominees for the position of delegate to the National Convention and to mail said ballot to all members at least twenty (20) days prior to the opening of the State Convention. Eligibility requirements of all nominees shall be verified before any member's name is added to the National Delegate Ballot. After the verification of the eligibility of nominees, there shall be a random drawing for positions on the National Delegate Ballot among all the qualified nominees.
  • PROPOSED LANGUAGE

    If there is a nominee or nominees left out of the drawing , that name or those names will be placed at the beginning of the ballot having a drawing among said nominees if more than one. Failed

17. Article IX, Section 2 Page 5

    The nominations of officers shall take place immediately following the final report of the credentials committee, said nominations shall not be closed until the presiding officer shall inquire three (3) times "Are there any more nominations?". Elections shall take place on the last day of the convention.

18. Art. V, Sec. 2, page 2

  • PRESENT LANGUAGE
    County or local Associations shall be entitled to representation in its association by one delegate at large and one delegate for each ten or major fraction thereof, of its membership, to be elected by secret ballot, one ballot offered to each member.

    The sealed plain envelope containing the ballot shall be returned to the P.O. Box in the State Convention City by the member in another envelope clearly identifying name, address and local unit of the member to permit verification of membership enrollment and to maintain the integrity of the voting procedure.

State Constitution & By-Laws:

Article XIII Section 2

    Certification of delegates will be conducted concurrent with registration and shall end no later than the sounding of the gavel at the opening of the business session on the second (2nd) day of the convention.
